These terms are legally binding. If you do not agree, please do not use our services.
1. Definitions
Throughout these Terms of Service:
- "Dive In Hurghada" or "we" refers to Dive In Hurghada Scuba Diving Center, registered in Hurghada, Egypt.
- "Customer," "you," or "diver" refers to any person booking or participating in our diving services.
- "Services" includes daily diving trips, PADI courses, snorkeling tours, private charters, and equipment rental.
- "Booking" refers to a confirmed reservation for any of our services.
2. Booking and Payment
2.1 How to Book
You can book our services through:

2.2 Payment Terms
- Deposit: A 20% deposit is required to confirm your booking. The remaining balance is due on the day of the dive.
- Accepted Currencies: USD, EUR, EGP
- Payment Methods: Cash (USD/EUR/EGP), Credit Card (Visa, Mastercard), PayPal, Bank Transfer
- Credit Card Fees: A 3% processing fee applies to credit card payments.
- PADI Course Fees: Full payment required at least 48 hours before course start date.
2.3 Booking Confirmation
Your booking is only confirmed after:
- Receipt of the required deposit
- Written confirmation from Dive In Hurghada (email or WhatsApp)
- Completion of the medical questionnaire (for diving activities)
3. Cancellation and Refund Policy
3.1 Cancellation by Customer

3.2 Cancellation by Dive In Hurghada
We reserve the right to cancel or reschedule dives due to:
- Unsafe weather or sea conditions (high winds, poor visibility, strong currents)
- Mechanical failure of dive boats
- Minimum participant numbers not met (minimum 2 divers for regular trips)
- Force majeure events (political unrest, natural disasters, pandemics)
In such cases, you will receive a full refund or the option to reschedule at no extra cost.
3.3 Medical Cancellation
If you are medically unfit to dive (certified by a doctor), you will receive a full refund upon presentation of a medical certificate.
4. Diving Requirements and Safety
⚠️ Important Safety Notice
Scuba diving is an inherently risky activity. By participating, you acknowledge and accept these risks. Your safety is our highest priority, but diving accidents can and do occur even under professional supervision.
4.1 Medical Fitness
All divers must complete the PADI Medical Statement before diving. You may NOT dive if you have any of the following conditions without medical clearance:
- Heart disease or cardiovascular conditions
- Epilepsy or seizure disorders
- Severe asthma or respiratory conditions
- Diabetes requiring insulin
- Pregnancy
- Recent surgery (within 6 months)
- Ear or sinus problems
- High blood pressure (uncontrolled)
False medical declarations are grounds for immediate exclusion from diving without refund.
4.2 Age Requirements
- Minimum Age: 10 years old for PADI Junior Open Water
- Adult Diving: 15 years and older for standard PADI Open Water
- Children under 10: Snorkeling only (with parent/guardian)
- Parental Consent: Required for all divers under 18
4.3 Certification Requirements
- Daily Diving Trips: Valid Open Water certification or equivalent required
- Advanced Dive Sites: Advanced Open Water or Deep Diver certification required
- Wreck Diving: Wreck Diver specialty or equivalent experience required
- Night Diving: Night Diver specialty or equivalent experience required
We accept certifications from PADI, SSI, NAUI, BSAC, and other recognized agencies. Please bring your certification card and logbook.
4.4 Equipment
- Full equipment rental is included in all diving packages
- Personal equipment is welcome but must be inspected by our staff
- Damaged or lost rental equipment will be charged at replacement cost
- We reserve the right to refuse personal equipment that does not meet safety standards
5. Liability and Insurance
5.1 Limitation of Liability
To the maximum extent permitted by Egyptian law:
- Dive In Hurghada's total liability shall not exceed the amount paid for the specific booking
- We are not liable for indirect, consequential, or punitive damages
- We are not responsible for loss or damage to personal belongings
- We are not liable for injuries resulting from diver negligence or failure to follow instructions
5.2 Diving Insurance
All divers must have valid diving insurance covering:
- Hyperbaric chamber treatment (decompression sickness)
- Emergency medical evacuation
- Accident and injury coverage
We recommend DAN (Divers Alert Network) or equivalent coverage. We can assist with temporary insurance purchase if needed.
5.3 Assumption of Risk
By participating in our diving activities, you acknowledge that:
- Scuba diving involves inherent risks including drowning, decompression sickness, barotrauma, and marine life injuries
- These risks cannot be completely eliminated even with professional supervision
- You voluntarily assume all risks associated with diving
- You will follow all safety briefings and instructions from our dive professionals
6. Behavior and Conduct
We reserve the right to exclude any participant who:
- Consumes alcohol or drugs before or during diving activities
- Disregards safety instructions or dive briefings
- Harasses marine life or damages coral reefs
- Behaves aggressively or disruptively toward staff or other divers
- Violates Egyptian diving regulations
Exclusion for safety violations is at the discretion of the Divemaster or Instructor and carries no refund.
7. Photography and Media
- Underwater photography and video services are available for an additional fee
- We may take promotional photos during dives. By participating, you consent to the use of your image in marketing materials unless you explicitly opt out in writing
- Copyright of all photos and videos taken by our staff remains with Dive In Hurghada unless otherwise agreed
8. Force Majeure
Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including:
- Natural disasters (storms, earthquakes, floods)
- Political unrest, war, or terrorism
- Pandemics or epidemics
- Government restrictions or travel bans
- Strikes or industrial actions
9. Governing Law and Dispute Resolution
These terms are governed by the laws of the Arab Republic of Egypt. Any disputes shall be resolved through:
- Good faith negotiation between parties
- Mediation by the Egyptian Chamber of Diving and Watersports (CDWS)
- Arbitration in Hurghada, Egypt, if mediation fails
10. Changes to Terms
We may update these Terms of Service at any time. The current version will always be available on this page with the "Last Updated" date. Continued use of our services constitutes acceptance of the revised terms.
